We cannot agree with the majority that there is a reasonable view of the evidence, viewed in the light most favorable to defendant (see People v Banks, 76 NY2d 799, 800 [1990]), that would enable a jury to find that defendant took property from the surplus warehouse of the Seneca County Sheriffs Department “under a claim of right made in good faith” (Penal Law § 155.15 [1]; see People v Cunningham, 12 AD3d 1131, 1132 [2004], lv denied 4 NY3d 829 , 5 NY3d 761 [2005]; People v Geppner, 122 AD2d 394, 396 [1986]; cf. People v Ace, 51 AD3d 1379 [2008], lv denied 11 NY3d 733 [2008]).

Upon review of the record, we are unpersuaded that counsel’s strategy during jury selection fell below the requisite level of effective assistance (see People v Wright, 297 AD2d 875, 875 [2002]; People v Driscoll, 251 AD2d 759, 761 [1998], lv denied 92 NY2d 896 [1998]; see also People v Davis, 15 AD3d 930, 931-932 [2005], lv denied 5 NY3d 761 [2005]) and review of the entire record reveals that defendant received meaningful representation.
