Lead Opinion

In re: Della Tassin, wife of, and Wess H. Tassin applying- for certiorari, or writ of review, to the Court of Appeal, Fourth Circuit, Parish of Jefferson. 310 So.2d 680.

Application denied. There is no error of law in the court of appeal judgment.

Concurrence

TATE, J.,

concurs in the result. The real effect of the court of appeal’s evaluation of the facts is a finding that there was no agreement providing indefinitely that the plaintiff was entitled to rely upon to delay filing his suit until after prescription ran.
