[4] In light of this conclusion, the Board found it unnecessary to review the determination that Consolidation had successfully rebutted the presumption under subsection (b)(2) of the DOL interim regulations. [5] In addition to the Third Circuit, the Seventh Circuit has concluded that the third rebuttal provision of the DOL interim regulation is not more restrictive than the criteria applied by HEW.

UNITED STATES of America, Plaintiff-Appellee,
v.
Dennis M. BROMLEY, Defendant-Appellant.

No. 89-6323.

United States Court of Appeals, Fourth Circuit.

Submitted Jan. 30, 1990.
Decided April 20, 1990.

Appeal from the United States District Court for the Eastern District of Virginia, at Alexandria. Claude M. Hilton, District Judge. (CR No. 86-138-A, CA No. 88-401-AM)

Dennis M. Bromley, appellant pro se.

Stephen G. Winerip, Office of the United States Attorney, Alexandria, Va., for appellee.

E.D.Va.

AFFIRMED.

Before DONALD RUSSELL, PHILLIPS and SPROUSE, Circuit Judges.

PER CURIAM:

1

Dennis M. Bromley appeals from the district court's order refusing relief under 28 U.S.C. Sec. 2255. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Bromley, CR No. 86-138-A (E.D.Va. Oct. 10, 1989). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
