F.S. 1013.3851013.385 School district construction flexibility; exception to public shelter design criteria.—A district school board may, with a majority vote at a public meeting that begins no earlier than 5 p.m., adopt a resolution to implement one or more exceptions to the educational facilities construction requirements to provide a school with the ability to operate in a facility on the same basis as a charter school pursuant to s. 1002.33(18). When a hurricane evacuation shelter deficit, as determined by the Division of Emergency Management, in the regional planning council region in which the county is located makes public shelter design criteria applicable, any exceptions to the public shelter design criteria remain subject to the concurrence of the applicable local emergency management agency or the Division of Emergency Management.
