[4] The Hickman case was decided before Rule 26(b) was amended to include the last sentence of the present version of it, quoted above, but the limitations stated respecting inquiries touching upon what might be termed near-privileged matters should, we think, still pertain. [5] We repectfully differ from the view of the concurring justice that we should not take cognizance of this point in the absence of defendants.
