In Johnson v. Ryder Truck Lines, Inc., 575 F.2d 471 (4th Cir. 1978), cert. denied, 440 U.S. 979 1979), we found Title VII and Sec. 1981 remedies to be separate, independent and distinct 3 Indeed, it appears that the appellant himself was in violation of the company limitations on permissible excused absences 4 The majority's decision here, I suggest is not consistent with the broad construction of the Seventh Amendment recently given by the Supreme Court in Tull v. United States, 55 USLW 4571 (U.S. April 28, 1987).
