The law regarding ineffective assistance of counsel claims is well settled and well documented. In Strickland v. Washington, 466 U.S. 668, 104 S.Ct. 2052, 80 L.Ed.2d 674 (1984), the Supreme Court set forth a two-part test for analyzing ineffective assistance of counsel claims. According to Strickland, first, the defendant must show that counsel's performance was deficient. This requires showing that counsel made errors so serious that counsel was not functioning as the “counsel” guaranteed the defendant by the Sixth Amendment. Second, the defendant must show that the deficient performance prejudiced the defense. This requires showing that counsel's errors were so serious as to deprive the defendant of a fair trial, a trial whose result is reliable. Strickland, 466 U.S. at 687, 104 S.Ct. 2052.
The Eighth Amendment is violated when prison officials are deliberately indifferent to a prisoner's “serious medical needs.” Estelle, 429 U.S. at 104, 97 S.Ct. at 291. To “prove a claim for deliberate indifference,” a plaintiff must show: (1) a “serious medical need (the objective component)”; (2) a prison official's “deliberate indifference to that serious medical need (the subjective component); and (3) the official's wrongful conduct caused the injury.” Fischer v. Fed. Bureau of Prisons, 349 Fed.Appx. 372, 374 (11th Cir. 2009) (citing to Goebert v. Lee Cnty., 510 F.3d 1312, 1326 (11th Cir. 2007)). “To satisfy the subjective component, the plaintiff must prove the prison official subjectively knew of a risk of serious harm, the official disregarded that risk, and the official's conduct was more than gross negligence.” Fischer, 349 Fed.Appx. at 374 (citation omitted).
In a copyright infringement case, “a copyright owner may choose between two types of damages: actual damages and profits or statutory damages.” Jordan v. Time, Inc., 111 F.3d 102, 104 (11th Cir. 1997). “Courts have discretion to award between $750 and $30,000 in statutory damages for all infringements of each work under 17 U.S.C. § 504(c).” StockFood Am., Inc. v. Smarter Changes, LLC, No. 6:19-CV-391-PGB-DCI, 2019 WL 11499353, at *4 (M.D. Fla. Sept. 19, 2019), adopted by 2019 WL 11499358 (M.D. Fla. Oct. 4, 2019). Statutory damages must be calculated according to the number of separately copyrightable works infringed, not on the number of infringements. Disney Enters., Inc. v. Law, No. 6:07-cv-1153-GKS-GJK, 2008 WL 203393, at *4 (M.D. Fla. Jan. 23, 2008). A copyright owner may elect statutory damages instead of actual damages at any time prior to final judgment. See 17 U.S.C. § 504(c)(1); Yellow Pages Photos, Inc. v. Ziplocal, LP, 795 F.3d 1255, 1271 (11th Cir. 2015); Clever Covers, Inc. v. Sw. Fla. Storm Def., 554 F.Supp.2d 1303, 1309 (M.D. Fla. 2008).
To raise a successful claim of ineffective assistance of counsel, a defendant must demonstrate both that (1) counsel's performance was deficient, meaning that it fell below an objective standard of reasonableness; and (2) the defendant was prejudiced by the deficient performance-that is, there was a reasonable probability that the result of the proceeding would have been different but for counsel's errors. Strickland v. Washington, 466 U.S. 668, 687-88, 694, 104 S.Ct. 2052, 2064, 2068 (1984). As to the first prong, the defendant must show that the advice given to him by counsel fell below the minimum standards of competency under the professional norms, not merely that it varied from best practices. Id. at 690, 104 S.Ct. at 2066. Our evaluation of counsel's performance is highly deferential, and there is a strong presumption that counsel acted within the professional norms set for competent assistance. Id. at 689, 104 S.Ct. at 2065. As to the second prong, it is not enough for the defendant to show that the error had some conceivable effect on the outcome of the proceeding. Third, §13 of the Act requires some form of surface water connection between a tributary and traditionally navigable waters. See 33 U.S.C. §407 (prohibiting depositing refuse "into any tributary of any navigable water from which the same shall float or be washed into such navigable water"). To be sure, the Refuse Act also prohibits leaving refuse "on the bank of any navigable water, or on the bank of any tributary of any navigable water, where the same shall be liable to be washed into such navigable water." Ibid. But, this prohibition reflects nothing more than Congress' traditional authority to regulate acts done on land that directly impair the navigability of traditionally navigable waters. See Rio Grande Dam & Irrigation Co., 174 U.S., at 708 (explaining that the Act reaches "any obstruction to the navigable capacity, and anything, wherever done or however done, . . . which tends to destroy the navigable capacity of one of the navigable waters of the United States"); see also Northern Pacific R. Co. v. United States, 104 F. 691, 693 (CA8 1900); Coombs, 12 Pet., at 78. It does not mean that the land itself is a navigable water.
Our precedents have also recognized the principle that a taxpayer is entitled to the surplus in excess of the debt owed. In United States v. Taylor, 104 U.S. 216 (1881), an Arkansas taxpayer whose property had been sold to satisfy a tax debt sought to recover the surplus from the sale. A nationwide tax had been imposed by Congress in 1861 to raise funds for the Civil War. Under that statute, if a taxpayer did not pay, his property would be sold and "the surplus of the proceeds of the sale [would] be paid to the owner." Act of Aug. 5, 1861, §36, 12 Stat. 304. The next year, Congress added a 50 percent penalty in the rebelling States, but made no mention of the owner's right to surplus after a tax sale. See Act of June 7, 1862, §1, 12 Stat. 422. Taylor's property had been sold for failure to pay taxes under the 1862 Act, but he sought to recover the surplus under the 1861 Act. Though the 1862 Act "ma[de] no mention of the right of the owner of the lands to receive the surplus proceeds of their sale," we held that the taxpayer was entitled to the surplus because nothing in the 1862 Act took "from the owner the right accorded him by the act of 1861, of applying for and…
Among the grounds used by the trial court was the conclusion of law that D'Arcy could not establish a taking under the factors outlined in Penn Central Transportation Company v. City of New York, 438 U.S. 104 (1978). In Penn Central, the United States Supreme Court explained that there is no "set formula" for identifying a taking forbidden by the Fifth Amendment. Id. at 123. Instead, the Court has utilized "ad hoc, factual inquiries into the circumstances of each particular case" and has identified three factors to aid in such inquiries. Connolly v. Pension Benefit Guar. Corp., 475 U.S. 211, 225 (1986) (quoting Penn Central, 438 U.S. at 124). Those factors are: (1) the plaintiff's reasonable investment-backed expectations; (2) the character of the government action; and (3) the regulation's economic impact on the property. Id.
