Dr. Finkelstein's Motion technically requests both a temporary restraining order and a preliminary injunction. See Motion at 4. The main difference between these two forms of equitable relief is that a temporary restraining order may be issued “without written or oral notice to the adverse party or its attorney[.]” FED. R. CIV. P. 65(b); see generally 11A CHARLES ALAN WRIGHT & ARTHUR R. MILLER, ET AL., FEDERAL PRACTICE AND PROCEDURE § 2951 (3d ed., Apr. 2023 update). For two reasons, we (like Magistrate Judge Reid) will only focus on the request for a preliminary injunction. One, our Defendants (the opposing party) “[had] notice of the application for the temporary restraining order,” so a temporary restraining order (if granted) would not “differ functionally from a preliminary injunction.” United States v. State of Ala., 791 F.2d 1450, 1458 (11th Cir. 1986) (quoting Dilworth v. Riner, 343 F.2d 226, 229 (5th Cir. 1965)). Two, the analysis for both forms of equitable relief is identical because both rely on the same four-factor test. See Parker v. Carter's appellate brief sheds some light on what he had in mind. There, he says that, "[w]hen three other inmates housed below [Carter] started slamming their locker lids and complaining about denial of the [Ramadan] meal, Sergeant Merritt, set upon causing [Carter] ill will and cruel punishment for his previous action, notified his supervisor Lt. Walin that it was [Carter] being disorderly again. Within minutes," Lt. Walin and Sgt. Williams appeared at Carter's cell and sprayed him. He also says that "[t]wo disciplinary reports were fabricated" following the spraying but "upon further investigation were not processed." But a party cannot amend his complaint by raising new facts in his appellate brief, so we do not consider these assertions in reviewing the district court's dismissal order. See Adams ex rel. Kasper v. Sch. Bd. of St. Johns Cnty., 57 F.4th 791, 799 n.2 (11th Cir. 2022) (en banc) ("Adams cannot amend the complaint by arguments made in an appellate brief.").
Plaintiff argues that the supportability analysis is flawed, as the ALJ “cherrypicked” evidence to support his conclusion and ignored evidence that supported ARNP Newby's opinion. This argument is without merit. As set forth above, there is ample evidence that supports the conclusions that Plaintiff's medications were effective and her condition improved with medication. Moreover, the ALJ is not required to address every piece of evidence in his decision. McCruter v. Bowen, 791 F.2d 1544, 1548 (11th Cir. 1986). Regardless, Plaintiffs' argument is, in essence, a request that the Court reweigh the evidence, which it cannot do. See Moore v. Barnhart, 405 F.3d 1208, 1213 (11th Cir. 2005).
Turning to remaining subsection (5), the Court finds that the September 28, 2021 letter references neither a “violation of any federal, state, or local law, rule, or regulation,” nor does it identify any act of “gross mismanagement, malfeasance, misfeasance, gross waste of public funds . . . or gross neglect of duty,” sufficient to trigger the FWA's protections. Fla. Stat. § 112.3187(5); see also Pickford v. Taylor Cnty. Sch. Dist., 298 So.3d 707, 711 (Fla. 1st DCA 2020) (holding that former substitute teacher's letter sent to elementary school principal disputing his pay rate was not statutorily protected disclosure under the FWA because it failed to identify any violation of law, rule, or policy that would present a substantial and specific danger to the public's health, safety, or welfare, nor did it identify any act of misfeasance, malfeasance, or other gross conduct that would have triggered the FWA's protections.); Henley v. Substantial evidence is relevant evidence, less than a preponderance but greater than a scintilla, that "a reasonable person would accept as adequate to support a conclusion." Viverette, 13 F.4th at 1314. We "may not decide the facts anew, reweigh the evidence, or substitute our judgment for that of the ALJ." Id. (alteration adopted). But a decision is not based on substantial evidence if it focuses on one aspect of the evidence while disregarding contrary evidence. McCruter v. Bowen, 791 F.2d 1544, 1548 (11th Cir. 1986).

The severity of an impairment “must be measured in terms of its effect upon ability to work, and not simply in terms of deviation from purely medical standards of bodily perfection or normality.” McCruter v. Bowen, 791 F.2d 1544, 1547 (11th Cir. 1986). The impairment must also last or be expected to last for a continuous period of at least 12 months. 20 C.F.R. §§ 404.1520(a)(4)(ii), 404.1509, 416.920(a)(4)(ii), 416.909. The claimant bears the burden at step two of proving that she has a severe impairment or combination of impairments. O'Bier v. Comm'r of Soc. Sec. Admin., 338 Fed.Appx. 796, 798 (11th Cir. 2009).
Plaintiff responds that Pacific Life's claims arise from U.S. Bank's business activities because there is a “direct affiliation, nexus, or substantial connection” between those activities and claims. ECF No. [60] at 14 (quoting Glovegold Shipping, Ltd. v. Sveriges Angfartygs Assurans Forening, 791 So.2d 4, 10 (Fla. 1st DCA 2000)). In Glovegold, the Florida First District Court of Appeal considered whether it had jurisdiction over a defendant that “provides insurance for vessels throughout the world.” Glovegold, 791 So.2d at 6-7. The defendant in that case issued a hull and machinery (H&M) insurance policy “for the period from July 31, 1995, to December 31, 1995.” Id. at 8. Affidavits submitted by the plaintiff in opposition to a motion to dismiss established that the insured vessel was in Florida when the contract for insurance was initially executed and when the coverage was extended. Id. at *10. The Glovegold court therefore determined that a direct affiliation with Florida existed and there was personal jurisdiction. Id. at 10-11.
