The 2011 amendment, effective July 1, 2011, in subsection (b), in the first sentence, substituted "such facility" for "such pipe" in two places, substituted "public rights of way of any highway, road, or street" for "rights of way of any road, bridge, or other transportation project", added "file a notice of abandonment with the department if the facility is located upon the public rights of way under the authority of the department" at the end, and added "Upon abandonment, the entity shall" at the beginning of the second sentence; and substituted the present provisions of subsection (d) for the former provisions, which read: "Any costs, claims, or other liability associated with the entity's decision pursuant to subsection (b) of this Code section shall be borne by the entity and may be subject to offset by the department."
