In determining the identity of the offenses for the purpose of establishing double jeopardy, two tests have been utilized by the courts — the “same transaction” test and the “same evidence test.” Justice Brennan has stated the “same transaction” test as follows: “In my view, the Double Jeopardy Clause requires the prosecution, except in most limited circumstances, to join at one trial all the charges against a defendant that grow out of a single criminal act, occurrence, episode, or transaction.” Ashe v.
