People v. Jones
Although defendant further contends that defense counsel was ineffective for failing to call defendant's father as a witness, defendant failed to "demonstrate the absence of strategic or other legitimate explanations" for that alleged deficiency ( People v Baker , 14 NY3d 266, 270-271 [2010] [internal quotation marks omitted]; see People v Botting , 8 AD3d 1064 , 1066 [4th Dept 2004], lv denied 3 NY3d 671 [2004]; cf. People v. Floyd
In any event, reversal would not be required based on the court’s allegedly insufficient inquiry inasmuch as “there is no indication here that the potential conflict bore a ‘substantial relation’ to the representation” (People v Harris, 99 NY2d 202, 211 [2002]; see People v Botting, 8 AD3d 1064, 1065-1066 [2004], lv denied 3 NY3d 671 [2004]).

People v. Scott
After stopping defendant’s car upon reasonable suspicion that one of the occupants had purchased drugs, and after lawfully recovering quantities of drugs from the codefendant-passenger’s person and from a pouch on his lap, “there was clearly reason to believe that the automobile might contain other drugs,” which justified a search of the entire vehicle, including the trunk, pursuant to the automobile exception (People v Belton, 55 NY2d 49, 55 [1982]; see also People v Cruz, 7 AD3d 335 [2004], lv denied 3 NY3d 671 [2004]).

People v. Cooper
The unrefuted police testimony demonstrates, and it is not seriously disputed, that police had probable cause to arrest defendant based upon the arresting officer’s observation of a “green leafy substance”— later confirmed to be marihuana — in a clear plastic bag in open view in defendant’s illegally parked car (see People v Pugh, 243 AD2d 360 [1997]; see also People v Cruz [Cabrera], 7 AD3d 335 [2004], lv denied 3 NY3d 671 , 672 [2004]).
