Although 'advanced age' may constitute a basis for a downward departure, the defendant, who was convicted of further offenses while incarcerated, including attempted assault in the second degree in 2018, failed to establish that his age at the time of the 2021 SORA hearing constituted an appropriate mitigating factor and minimized his risk of reoffense ( see People v Thorpe , 186 AD3d 629, 630).

ORDERED that the application is denied.

The appellant has failed to establish that he was denied the effective assistance of appellate counsel (see Jones v Barnes, 463 US 745; People v Stultz, 2 NY3d 277).
