The Appellate Division simply affirmed ( 40 AD2d 956 [1st Dept 1972]), and this Court affirmed “[n]o opinion” ( 33 NY2d 537, 538 [1973]), declining an opportunity to affirm on the reasoning of the trial court, as we have done innumerable times when that is our intention. “[S]tare decisis does not spring full-grown from a ‘precedent’ but from precedents which reflect principle and doctrine rationally evolved” (People v Hobson, 39 NY2d 479, 488 [1976]).
