The amicus brief here points out that a Division attorney does appear at the hearing "if the complainant has not retained private counsel; if the complainant has retained private counsel the Division attorney appears at the Division's option to protect the public interest." 7 The Amicus brief submitted by the Division states that in 1977 it was forced to reassess and restructure the allocation of Division attorneys.
