See United States v. Crews, 30 F.3d 131 , 1994 WL 396339, *1 (4th Cir.1994) (affirming finding of voluntary consent where defendant said nothing in response to request to search his person, but raised his hands to one side, in a manner and presentation as if he were opening up his arms.) Even when a defendant verbally refuses consent, his subsequent or contemporaneous actions may be found sufficient to constitute consent.

UNITED STATES of America, Plaintiff Appellee,
v.
Kevin Ronald ADAMS, Defendant Appellant.

No. 93-6685.

United States Court of Appeals, Fourth Circuit.

Submitted: June 23, 1994.
Decided: July 14, 1994.

Appeal from the United States District Court for the District of Maryland, at Baltimore. Frederic N. Smalkin, District Judge. (CR-89-434-S, CA-93-1723-S)

Kevin Ronald Adams, Appellant Pro Se.

Harvey Ellis Eisenberg, Assistant United States Attorney, Baltimore, Maryland, for Appellee.

D.Md.

AFFIRMED.

Before MURNAGHAN and WILKINS, Circuit Judges, and SPROUSE, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, although we grant Adams in forma pauperis status, we affirm on the reasoning of the district court. United States v. Adams, Nos. CR-89-434-S; CA-93-1723-S (D. Md. June 14, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
