Any attorney who shall exchange any contract or indemnity of the kind and character specified in this chapter or who shall directly or indirectly solicit or negotiate any application for the contracts without first complying with all the provisions of this chapter shall be guilty of a misdemeanor, but the Commissioner may in his discretion and upon such terms and conditions as he may prescribe issue a permit for organizational purposes to continue in force and effect until canceled at the pleasure of the Commissioner.

CHAPTER 20 HEALTH CARE PLANS Sec.

Sec. Short title. Purpose and construction of chapter. Definitions. Authorization of formation of health care corporations generally. Procedure for formation of health care corporations; regulation and supervision of corporations by Commissioner generally. Board of directors; merger or consolidation of medical service corporations and hospital service corporations; powers of health care corporations generally [Repealed]. Bond of treasurer; deposit of funds collected from subscribers. Requirements for certificate of authority; application. Certificate of authority issuance. Expiration, renewal, and amendment of certificate of authority. Refusal, revocation, or suspension of certificate of authority generally. Mandatory refusal, revocation, or suspension. Management of corporations; general powers; requirements as to reserves, minimum subscriber’s surpluses, and charges. Acceptance of applications. Issuance and contents of membership certificates. Right to become participating physician or approved health care provider. Powers of corporations to contract for provision of health care services; receipt of payments.
