Md. Rule 12-402. Definitions

In this Chapter, the following definitions apply except as expressly otherwise provided or as necessary implication requires:

(a) Court. “Court” means the circuit court for a county, sitting as a circuit court.

Committee note: In this Chapter, “court” does not include a circuit court sitting as the Orphans' Court of the county.

(b) Determination of Value. “Determination of value” means a court order determining the fair market value of real property under Code, Real Property Article, § 14-707 or § 14-711 or adopting the valuation of the property agreed to by all cotenants.

(c) Partition by Sale. “Partition by sale” means a court-ordered sale of real property, whether by auction, sealed bids, or open-market sale conducted under Code, Real Property Article, § 14-711.

(d) Partition in Kind. “Partition in kind” means the division of real property into physically distinct and separately titled parcels.

(e) Record. “Record” means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form.
