Rule 13.03. Petition and Response to Petition.

(a) A petition for a writ of review must be filed with the reviewing court within 15 days after entry of the order from which relief is sought. Each petition shall be accompanied by: (1) a docket fee; or (2) a petitioner in a criminal case eligible to proceed in forma pauperis shall file a motion for leave to proceed, together with an affidavit document- ing the petitioner’s inability to pay fees and costs or to give security. The affidavit shall have attached a statement from the institution in which petitioner is incarcerated detailing income and expenses for the prior six months. (b) Any party may file a response within 15 days after filing of the petition. (c) The reviewing court may grant the petition anytime after the 30th day after entry of the order from which relief is sought or as soon as both the petition and the response have been filed with the reviewing court. petition shall be deemed denied if the reviewing court does not accept review within 40 days from the date of filing of the petition. (d) Rule 1.01 applies.
