  1. This subchapter governs an agreement to arbitrate made on or after July 27, 2011.

Subject matter was clear from the arbitration provision, there was mutual obligation because both sides had to arbitrate all controversies other than collection cases, and there was mutual agreement, with both parties assenting to the agreement having a meeting of the minds, and thus all the elements of a contract had been met and the parties entered into an agreement to arbitrate the disputes raised in the petition.
