Law Governing Social Security Claims A court may set aside a decision of the Commissioner “only if the factual findings are not supported by substantial evidence or if the decision is based on legal error.” Burgess v. Astrue, 537 F.3d 117, 127 (2d Cir.2008) (citation and internal punctuation omitted); accord Acierno v. Barnhart, 475 F.3d 77, 80-81 (2d Cir.) (citing Pollard v. Halter, 377 F.3d 183, 188 (2d Cir.2004)), cert. denied, 551 U.S. 1132 , 127 S.Ct. 2981 , 168 L.Ed.2d 704 (2007).
