Granted. The sentence is set aside, and the case is remanded for resentencing in accordance with law. See La.C.Cr.P. Art. 880.
Concurrence
agrees with the ruling of this Court. In addition, it is noted that 5 months is an apparently severe sentence for[*145] the crime charged for a 26-year old man with an apparently good record, except for a problem with alcohol. Even so, what the relator did was serious, and the apparent consequences were disastrous.
