OPINION of the Cojitt, by

Judge Owsley.

We are of opinion the proceedings had in this cause in the court below are manifestly irregular. The declaration, contrary to all precedent, makes the lessor in the demise laid in the declaration the casual ejector.

Judgment reversed.
