2025SDCL 15-6-8(c) provides, “[i]n pleading to a preceding pleading, a party shall set forth affirmatively” any defenses that constitute “an avoidance or affirmative defense.” We require affirmative defenses to be specifically pled, and “failure to do so [will] result in the defense being barred.” Century 21 Associated Realty v. Hoffman, 503 N.W.2d 861, 865 (S.D. 1993). [¶33.] The Court has not previously considered whether the absolute privilege of SDCL 20-11-5(2) is an affirmative defense.
