Any person who fails or refuses to comply with § 27-53-202 or § 27-53-203 shall be punished upon a conviction in the county where the accident occurred by a fine of not less than one hundred dollars ($100) nor more than one thousand dollars ($1,000).
For willful refusal to comply with § 27-53-202 or § 27-53-203, the Commissioner of Motor Vehicles shall revoke the driver's license or commercial driver's license of the person so convicted.
Although this section subjects to statutory fine or suspension of license to drive any motorist who fails to render a required automobile accident report, there is no such penalty for a motorist who refuses to answer the questions of the investigating officer. Stephens v. State, 320 Ark. 426, 898 S.W.2d 435 (1995).
