State v. Bodtmann
In support of its position the State cites cases such as United States v. Lefkowitz, 618 F. 2d 1313 (9th Cir.1980), cert. den. 449 U.S. 824 , 101 S.Ct. 86 , 66 L.Ed. 2d 27 *42 (1980), where an estranged wife had revealed her husband's scheme to falsify accounting records, and the Court rejected defendant husband's motion to suppress based on a violation of the marital privilege since the wife had not "testified" against her husband, but simply provided information to support a search warrant.
