In our view the trial court correctly concluded as a matter of law that the March 10 letter was not constitutionally protected as a statement of opinion only (see Gertz v Robert Welch, Inc., supra, pp 339-340; see, also, Rinaldi v Holt, Rinehart & Winston, 42 NY2d 369, 381 , mot for rearg den 42 NY2d 1015 , cert den 434 US 969 ).
