1951The doctrine of cy pres will not apply unless there is a general charitable purpose: Delaware Trust Co. v. Graham, supra. If a general charitable purpose is not shown, the doctrine of cy pres will not be applied: Murphy v. McBride, supra. In order judicially to determine whether or not a charitable trust which for some reason cannot be carried out within the prescribed plan of the testator should be executed cy pres, the primary intention of the testator must be determined.
