Subscribing Witness’ Testimony Unnecessary

The testimony of a subscribing witness is not necessary to authenticate a writing unless required by the laws of the jurisdiction whose laws govern the validity of the writing.

COMMITTEE COMMENT

The Committee finds that the Federal rules in to authentication and identification and thereby this area are for the most part an accurate rep- avoid the necessity of the search for a ‘‘case in resentation of Colorado case law, statutes, and point.’’ The rules would cover a number of the Rules of Procedure.
