Sec. 44-9. —Obtaining Presence of Unex- cused Defendant at Trial or Sentencing If the defendant is not present at the trial or a part thereof or the sentencing hearing and the defendant’s absence has not been excused, the judicial authority may issue a capias in accord- ance with the provisions of Section 38-21.
