Where covenants are dependent, the failure of performance by the opposing party may be a good defense.

JUDICIAL DECISIONS Covenants of grantor to make deed, and of grantee to pay the money, are mutual and dependent covenants, and action lies in favor of grantor for money or grantor’s offer to perform, and grantee thereupon failing or refusing to pay money.
