TITLE 21 ELECTIONS

Section 2. Elections and Primaries Generally, 21-2-1 through 21-2-604.

ARTICLE 7 PRECINCTS AND POLLING PLACES

21-2-260. Designation of precincts.

  1. Each election district existing as of December 31, 1982, shall constitute a separate precinct until and unless changed as provided in this article.
  2. The governing authority of each municipality shall determine and establish the number and boundaries of municipal voting precincts in accordance with the provisions of this article. Insofar as practicable, the precincts shall be the same as those for state and county elections.

If councilmen elected by wards, each ward should be separate election district (now precinct).

- If a municipality requires that each of its councilmen be elected from a different ward and the candidates are elected by the electors residing in that ward, each ward should be a separate election district (now precinct). 1969 Op. Att'y Gen. No. 69-399 (decided under former Code 1933, § 34-A-601).
