Section 21. Operators of Hotels, Inns, and Roadhouses, 43-21-1 through 43-21-62.

ARTICLE 3 ROADHOUSES AND PUBLIC DANCE HALLS

43-21-51. Application for license.

1. Every person, firm, or corporation making application for a license to engage in the business described in Code Section 43-21-50 shall make application to the county commissioners or the judge of the probate court of the county in which such business is to be operated. The application shall contain:
   1. The name and residence of the applicant and the length of his residence within the state;
   2. The address and place for which such license is desired;
   3. The name of the owner of the premises upon which the business licensed is to be located;
   4. A statement that the applicant intends to carry on the business authorized by the license for himself or under his immediate supervision and direction; and
   5. A statement that such applicant is of good moral character and has never been convicted of a felony involving moral turpitude.
2. The application prescribed in this Code section must be verified by the affidavit of the petitioner made before a notary public or other person duly authorized by law to administer oaths. If it appears from the statement of the applicant, or otherwise, that such applicant has been convicted of a felony involving moral turpitude, the license shall not be granted unless it shall appear to the satisfaction of the county commissioners or the judge of the probate court that the licensed premises will be operated in a lawful manner, in which case such official or officials may, in their discretion, issue such license. Before any such license shall be issued, the governing body of the county shall be satisfied that the statements required by this Code section are true.
