ARTICLE 3 GOVERNOR'S POWERS GENERALLY

50-16-64. Authority for Governor to purchase property at sheriff's sale under execution in favor of state.

At all sheriff's sales under any execution in favor of the state or the Governor, the Governor, or anyone authorized by him, may purchase the property so sold, provided that in no case shall more be bid for such property than the amount due the state upon the execution.

OPINIONS OF THE ATTORNEY GENERAL

Transfer of property purchased at sheriff's sale to department.

- Department need not request that the Governor prepare a deed conveying property purchased by the state through a sheriff's sale to a department; a department must request that the Governor execute an executive order transferring the use of the property to a department. 1970 Op. Att'y Gen. No. 70-15.

Disposition of acquired property.

- Property acquired by Highway Board (now Transportation Board) pursuant to issuance of fi. fa. must be sold or rented by board and cannot be appropriated to use of board. 1962 Op. Att'y Gen. p. 275.
