The 2016 amendment, effective July 1, 2016, inserted "that controls a bank" near the beginning of subsection (a); deleted "and prevent evasions thereof, and for the purpose of lessening the regulatory burden to waive certain requirements associated with the annual reporting requirements for bank holding companies that do not have their principal place of business in Georgia and do not own Georgia banks" following "Code section" in subsection (b); and, in subsection (d), in the first sentence, inserted "that control a bank" near the beginning, deleted "and other financial institutions" following "examines state banks" in the middle, and substituted "holding companies that control a bank" for "holding companies doing business in this state" at the end of the last sentence.
The 2017 amendment, effective June 1, 2017, inserted "chartered by the department" near the middle of subsection (a) and in the first and second sentences of subsection (d).
- Amendments to Georgia bank holding company statutes commit promulgation of rules for regulation, examination and control of bank holding companies doing business in Georgia to discretion of the commissioner, who should exercise the commissioner's discretion in issuance of rules and regulations to the extent necessary to effectuate the purposes of bank holding company statutes. 1976 Op.
