ARTICLE 11 RECORDS AND REPORTS OF CURRENCY TRANSACTIONS

7-1-916. Forfeiture of property involved in illegal transactions.

All property of every kind used or intended for use in the course of, derived from, or realized through a transaction which in fact involves the proceeds of unlawful activity specified in Chapter 14 of Title 16 or otherwise subject to the provisions of this article shall be subject to forfeiture to the state. Forfeiture shall be had by the same procedure as is set forth in Chapter 16 of Title 9. As used in this Code section, the terms "proceeds" and "property" shall have the same meaning as set forth in Code Section 9-16-2.

The 2015 amendment, effective July 1, 2015, substituted "Chapter 16 of Title 9." for "Code Section 16-14-7" in the next-to-last sentence and added the last sentence. See editor's note for applicability.

- Ga. L. 2015, p. 693, § 4-1/HB 233, not codified by the General Assembly, provides: "This Act shall become effective on July 1, 2015, and shall apply to seizures of property for forfeiture that occur on or after that date. Any such seizure that occurs before July 1, 2015, shall be governed by the statute in effect at the time of such seizure."
