(1) Except as provided in subsection (2) of this section, a city housing authority shall consist of the mayor, ex officio, or his designee, and four (4) persons appointed by him with the approval of the city legislative body. (2) If a city housing authority has agreed to accept a transfer or full transfer of ownership and operation of another city's public housing program pursuant to the United States Housing Act of 1937, the housing authority shall consist of the mayor, ex officio, or the mayor's designee; four (4) persons appointed by the mayor with the approval of the city legislative body; and one (1) additional person appointed by each mayor of a city divesting itself of its authority, with the approval of that city's legislative body.
