Taking by eminent domain

Section 7. The commonwealth may, at any time after one year's written notice to a railroad corporation, take its railroad, franchise and other property by eminent domain under chapter seventy-nine; provided, however, that said notice shall not be required if the corporation does not conduct railroad operations in the commonwealth.
