      409.810 Claim for refund; right to hearing. (1) A long term care facility that has paid an amount that is not required under ORS 409.800 to 409.816 and 409.900 may file a claim for refund with the Department of Human Services.

      (2) Any long term care facility aggrieved by an action of the Department of Human Services or by an action of the Director of Human Services taken under ORS 409.800 to 409.816 and 409.900 shall be entitled to notice and an opportunity for a contested case hearing under ORS chapter 183.       Note: 409.810 is repealed January 2, 2034, and applies to long term care facility assessments imposed before June 30, 2032. See sections 23 and 31, chapter 736, Oregon Laws 2003, as amended (second note under 409.900).
