Failure to disperse

Terms defined in Section 76-1-101.5 apply to this section.
An actor commits failure to disperse if the actor:
is at the scene of a riot, disorderly conduct, or an unlawful assembly; and
remains at the scene of the riot, disorderly conduct, or unlawful assembly after having been ordered to disperse by a peace officer.
A violation of Subsection (2) is a class C misdemeanor.
This section does not apply to an actor who attempts to leave the scene of a riot, disorderly conduct, or unlawful assembly but is unsuccessful in leaving the scene.
