Town of Holland, 2007 VT 133 (Vt. 2007). “The Legislature has placed all “[s]hade and ornamental trees within the limits of public ways and places” under the control of the tree warden, 24 V.S.A. § 2502, and, under 24 V.S.A. § 2508, a public shade tree may not be cut down except by the tree warden or his or her designee.”
