(a) Subject to W.S. 7-3-702(b)(ii), any person whose wire,
oral or electronic communication is intercepted, disclosed or
used in violation of this act may recover damages against any
person who intercepts, discloses, uses or procures any other
person to intercept, disclose or use the communications as
follows:
(i) Actual damages but not less than one thousand
dollars ($1,000.00) a day for each day of violation;
(ii) Punitive damages; and
(iii) Reasonable attorney's fees and other litigation
costs reasonably incurred.
(b) A good faith reliance on a court order constitutes a
complete defense to any civil or criminal action brought under
this act.
