See United States v. Williams, 674 F.2d 310, 312-13 (4th Cir.1982) (citing precedent in other jurisdictions supporting the use of Rule 60(b)(1) for subsequent changes in the law, but not deciding the issue); see also Malagrida v. Holland, 19 F.3d 1429 (Table), 1994 WL 89336 *4 (4th Cir.1994) (unpublished) (noting that the Circuits were split on the issue, stating that the Fourth Circuit had yet to address the issue, and finding that the case before the Court did not require a decision on the issue).

Clarence L. JACKSON; Edward W. Murray; D. A. Garraghty;
Constance C. Hill; C.S. Larsen; Faye Johnson;
Edward C. Morris, Defendants Appellees.

No. 93-7051.

United States Court of Appeals, Fourth Circuit.

Submitted March 17, 1994.
Decided March 31, 1994.

Appeal from the United States District Court for the Eastern District of Virginia, at Alexandria. Albert V. Bryan, Jr., Senior District Judge. (CA-91-700-AM)

Gary Lee Harris, appellant pro se.

Reneen Evat Hewlett, Office of the Attorney General of Virginia, Richmond, Va., for appellees.

E.D.Va.

AFFIRMED.

Before PHILLIPS and LUTTIG, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying relief on his 42 U.S.C. Sec. 1983 (1988) complaint. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Harris v. Jackson, No. CA-91-700-AM (E.D. Va. Sept. 13, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
