ARTICLE 15 MISCELLANEOUS OFFENSES

21-2-578. Unfolding, opening, or prying into ballots.

Any person who, before any ballot is deposited in the ballot box as provided by this chapter, willfully unfolds, opens, or pries into any such ballot with the intent to discover the manner in which the same has been marked shall be guilty of a misdemeanor.

The 2010 amendment, effective July 1, 2010, deleted "or ballot card" following "ballot" twice in this Code section.

OPINIONS OF THE ATTORNEY GENERAL

Fingerprinting not required.

- An offense under O.C.G.A. § 21-2-578 would not be designated as one which requires fingerprinting. 1998 Op. Att'y Gen. No. 98-20.
