ARTICLE 4 CLAIMS ADVISORY BOARD

28-5-105. Scope of compensation.

The General Assembly may by resolution appropriate money for payment of a claim for compensation upon the recommendation of the board for:

  1. Expenses actually and reasonably incurred as a result of the personal injury or death of the victim; and
  2. Loss of earning power as a result of total or partial incapacity of such victim.

OPINIONS OF THE ATTORNEY GENERAL

Compensation to injured inmates.

- Pursuant to the 1999 amendments, O.C.G.A. §§ 28-5-85 and28-5-105 prohibit the Claims Advisory Board from recommending compensation to an inmate injured while in the custody of the Department of Corrections. 1999 Op. Att'y Gen. No. 99-11.
