ARTICLE 3 REVOCABLE TRUSTS

53-12-43. Power of agent or conservator to revoke trust.

  1. A settlor's powers with respect to revocation, amendment, or distribution of trust property may be exercised by an agent under a power of attorney only to the extent expressly authorized by the trust instrument and the power.
  2. A settlor's powers with respect to revocation, amendment, or distribution of trust property may be exercised by the settlor's conservator only as provided in Code Section 29-5-23.
