If a nondomiciliary dies intestate owning real property located in this state, the real property shall be distributed to that decedent’s heirs in accordance with the laws of intestacy of this state.

Annotations

COMMENT This section clarifies that the intestacy laws of Georgia shall govern the distribution of real property located in Georgia owned by a person who dies intestate while domiciled elsewhere. The distribution of the intestate decedent’s personal property is not subject to the laws of Georgia.
