Any person who knowingly makes any false statement, or falsifies, or permits to be falsified, any record or records of the fund defined by KRS 95.851, in any attempt to defraud the fund, is guilty of a misdemeanor, and shall be fined not less than $500 or imprisoned in the county jail not less than twelve (12) months, or both, and the fund shall have the right to recover any payments made under false representations. History: Amended 1974 Ky. Acts ch. 396, sec. 12. -- Created 1956 Ky. Acts ch. 16, sec. 35, effective July 1, 1956. Formerly codified as KRS 95.885. Legislative Research Commission Note (11/21/96). This statute is the former KRS 95.885, as amended, renumbered by the Reviser of Statutes in 1974. Because of this renumbering, the phrase "the fund defined by KRS 95.851" has been substituted for the phrase "this fund" that appeared in the original text of the statute in 1958 Ky. Acts ch. 16, sec. 35. See KRS 7.136(1)(a).
