2013Chapel v. State, 270 Ga. 151, 155 (4) ( 510 SE2d 802 ) (1998), our Supreme Court held that “a comment upon a defendant’s silence or failure to come forward ... will not be allowed even where the defendant has not received Miranda warnings and where he takes the stand in his own defense.” In recent opinions, the Supreme Court of Georgia noted that former OCGA § 24-3-36 was repealed by the new Evidence Code, but the Court specifically did not rule on Mallory’s continued viability under the new Code because that issue was not squarely before the Court.
