1890Invoking the aid of that principle, it was held in Woodward Iron Co. v. Cabaniss, supra, that section 3640 of the Code secured to the parties the right of appeal to the Circuit Court, in which they could have the damages assessed by a jury as guaranteed to them by the organic law, and hence that the provisions of Article II, as amended, were not, when considered in connection with section 3640 of the Code, violative of the Constitution.
