2011While we certainly can rely on a party's concessions of fact, Logan v. Commonwealth, 47 Va.App. 168, 172 , 622 S.E.2d 771, 773 (2005) (en banc), before we do so we should ensure that the concession was intended and not simply implied from an erroneous recitation of facts. [5] The trial court expressly concluded that "the Commonwealth filed papers that characterized Detective Alston's statement differently than Detective Alston [did in his own testimony]." [6] The Wisconsin Supreme Court used a similar mode of analysis in Cunningham on the facts before it in that case.

1926The rule is well stated in Fletcher’s Equity-Pleading, sec. 618, as follows: “As a general rule, it (the court) has, however, the power of determining all questions of fact without resorting to this mode of inquiry, and it should not be employed except where the conflict of witnesses or the obscurity of evidence is such as to make it doubtful on which side the preponderance of evidence lies.” Citing inter alia, Williams v. Blakey, 76 Va. 254 ; Hord v. Colbert, 28 Gratt. (69 Va.) 49; Wise v. Lamb, 9 Gratt. (50 Va.) 294.
